Judge hands CLU win in Gallegly breach of contract lawsuit
A Ventura County Superior Court judge on Dec. 13 reversed his own intended ruling, handing California Lutheran University a win in its ongoing legal battle with former Congressman Elton Gallegly.
Gallegly and his wife, Janice, have sued the Thousand Oaks-based university for breach of contract, alleging it failed to fully establish the Elton and Janice Gallegly Center for Public Service and Civic Engagement on its campus.
Judge Henry Walsh issued an intended decision on Sept. 17 that there was a contractual basis for the establishment of a replica of Gallegly’s Washington D.C. office on the campus.
But Walsh reversed himself in his Dec. 13 ruling.
“In its erroneous statement of intended decision, the court stated how the testimony and evidence could be construed into a contract,” he wrote.
“Not so for a trust,” he wrote.
The case is still headed for trial to resolve other issues.
A trial-setting conference is scheduled for Jan. 25.
